1. About Insta Checkout
Insta Checkout is a software product operated by Insta Checkout LLC ("Insta Checkout", "we", "us"), a limited liability company registered in the Arab Republic of Egypt.
We provide a dashboard that lets sellers in Egypt create payment links and accept payments through the seller's own existing payment accounts — InstaPay, Fawry, Vodafone Cash, and Meeza. We are a software facilitator, not a payment institution, money services business, or licensed payment processor under Egyptian law. We do not hold, transfer, settle, or have custody of customer funds at any point. Every payment is made directly by the customer into the seller's own wallet, and confirmation is performed manually by the seller after the customer uploads a payment screenshot.
These Terms of Service ("Terms") govern your use of Insta Checkout, whether you use the service as a seller, as a customer paying through a seller's link, or simply as a visitor to our website.
2. Acceptance of Terms
By creating an Insta Checkout account, using a payment link generated through Insta Checkout, or otherwise interacting with our service, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not use the service. If you are using Insta Checkout on behalf of a business, you represent that you have the authority to bind that business to these Terms.
3. Eligibility
To create a seller account on Insta Checkout, you must be at least 18 years old, legally resident or established in Egypt, and able to enter into a binding contract under Egyptian law. You must provide accurate information about yourself and your business, and you must keep that information up to date.
We may decline, suspend, or terminate any account that we reasonably believe does not meet these eligibility requirements, or whose information appears false, incomplete, or misleading.
4. Seller Accounts
As a seller you are responsible for: (a) the accuracy of all information you publish through Insta Checkout, including product names, prices, descriptions, and payment instructions; (b) the legality of every product or service you sell through a payment link; (c) the security of your login credentials and the security of the payment wallets you connect to your account; (d) fulfilling your obligations to customers, including delivery of goods or services, customer support, and any refunds or chargebacks.
You must not share your account credentials with any party other than authorised members of your own team, and you must notify us as soon as you suspect unauthorised access. We are not liable for losses caused by your failure to keep your credentials secure.
5. Customer Interactions
When you pay through an Insta Checkout payment link as a customer, your transaction is directly between you and the seller. Insta Checkout is not a party to that transaction. The payment is made into the seller's own payment wallet through Egypt's regulated rails (InstaPay, Fawry, Vodafone Cash, or Meeza) and is confirmed by the seller after you upload a payment screenshot.
Any dispute about a product, refund, delivery, or the seller's behaviour is between you and the seller. Insta Checkout will reasonably assist by sharing relevant transaction metadata when required by law, but we are not financially responsible for, and cannot guarantee, the seller's performance.
6. Acceptable Use
You must not use Insta Checkout to sell, promote, or facilitate any product or service that is illegal under Egyptian law or that we determine, acting reasonably, to be high-risk for our service or our payment partners. Prohibited categories include but are not limited to: weapons, ammunition, and explosives; controlled substances or unlicensed pharmaceuticals; counterfeit or stolen goods; adult or pornographic content; gambling or lottery services; multi-level-marketing schemes, pyramid schemes, and unregistered investment products; any service that violates the intellectual property of others.
The full prohibited-use list will be expanded during legal review. Until then, this section is a non-exhaustive starting point and we may decline or remove activity outside of it when it conflicts with applicable law or our payment partners' rules.
7. Subscription Fees and Billing
Insta Checkout offers a Free plan and a paid Pro plan. The features and limits of each plan, and the price of the Pro plan, are described on our Pricing page and may be updated from time to time.
Pro-plan subscriptions are billed in advance for the chosen billing period. Fees paid for the unused remainder of a billing period are non-refundable except where required by Egyptian consumer-protection law. Failure to pay a renewal will downgrade the account to the Free plan; we will not delete your data automatically as a result of a missed payment.
Insta Checkout's subscription fees are entirely separate from the amounts customers pay sellers through payment links. We do not charge transaction fees on customer payments — those are governed by the seller's payment-wallet provider.
8. Suspension and Termination
You may close your seller account at any time from inside the dashboard. On closure, your account is moved to an inactive state and your payment links stop accepting new payments.
We may suspend or terminate your account if we reasonably believe you have breached these Terms, if a payment partner instructs us to do so, if required by Egyptian law or a court order, or if continued operation of your account creates a security or compliance risk. Where the circumstances allow, we will give you notice before suspension and a reasonable opportunity to address the issue.
9. Intellectual Property
Insta Checkout, the Insta Checkout name and logo, our website, our dashboard, and all related software, designs, and documentation are owned by Insta Checkout LLC or our licensors and are protected by Egyptian and international intellectual-property law.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use Insta Checkout solely as described in these Terms. You retain ownership of the content you upload (product descriptions, images, branding) and you grant us a worldwide, royalty-free licence to host, copy, display, and distribute that content as necessary to operate the service for you.
10. Disclaimers and Limitation of Liability
Insta Checkout is provided on an "as is" and "as available" basis. To the maximum extent permitted by Egyptian law, we make no warranties, express or implied, regarding the service's reliability, accuracy, fitness for a particular purpose, or uninterrupted availability.
To the maximum extent permitted by law, Insta Checkout's total aggregate liability to you for all claims arising out of or related to these Terms or your use of the service is limited to the greater of (a) the subscription fees you paid us in the twelve months preceding the event giving rise to the claim, or (b) one thousand Egyptian pounds (EGP 1,000).
We are not liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or business interruption, even if we were advised of the possibility of such damages. Nothing in this section limits liability that cannot be limited under Egyptian law.
11. Indemnification
You agree to defend, indemnify, and hold harmless Insta Checkout LLC, its affiliates, and its directors, officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your use of the service in violation of applicable law; (c) any product, service, or content you offer through a payment link; (d) your interactions with customers or third parties through the service.
12. Governing Law and Dispute Resolution
These Terms, and any dispute or claim arising out of or related to them or your use of Insta Checkout, are governed by the laws of the Arab Republic of Egypt without regard to its conflict-of-laws principles.
The parties will attempt to resolve any dispute amicably through good-faith negotiation. If a dispute cannot be resolved within 30 days of written notice, it will be brought exclusively before the competent courts of Cairo, Egypt.
13. Modifications to These Terms
We may update these Terms from time to time to reflect changes in our service, in applicable law, or in industry practice. When we make a material change we will notify registered sellers by email at least 30 days before the change takes effect, and we will update the "Last updated" date at the top of this page.
Continuing to use Insta Checkout after a change takes effect means you accept the updated Terms. If you do not accept a change, you must stop using the service before the effective date.
